Legal Expert Warns: E-Cigarette Use in Offices Violates UAE Smoking Laws

In a recent warning to UAE office workers and employers, a legal expert has clarified that the use of e-cigarettes in the workplace is illegal under federal tobacco control laws.

Despite a growing trend of vaping in enclosed office spaces, Mahmoud Kreidie, a lawyer at Ahmad Bin Hezeem and Associates LLP, emphasized that the practice violates strict regulations designed to control smoking in public areas.

Kreidie’s remarks, made in an interview, highlight a significant oversight by many who believe vaping may be exempt from the stringent smoking bans in place.

According to federal law, smoking, which includes vaping, is prohibited in enclosed public spaces and workplaces. This restriction extends to common areas such as lobbies and parking zones.

“E-cigarettes fall under the same category as traditional cigarettes when it comes to public health regulations,” Kreidie stated.

“The law is clear: smoking, including vaping, is banned in all enclosed public spaces, including workplaces. This applies to any area accessible to the public or where employees work.”

The law mandates that any designated smoking areas must meet strict conditions regarding isolation and ventilation, as specified by the competent authorities.

This means that areas where smoking is permitted must be distinctly separated from non-smoking areas and equipped with proper ventilation systems to ensure that smoke does not infiltrate non-smoking zones.

Violations of these regulations can result in immediate fines of Dh500 for minor infractions. For serious or repeat offenders, the penalties can be much harsher.

Kreidie warns that failing to comply with these laws could lead to substantial legal and financial repercussions for both individuals and businesses.

The growing prevalence of vaping in offices may be driven by a misconception that e-cigarettes do not fall under the same restrictions as traditional tobacco products.

However, Kreidie underscores that the intent of the law is to create a smoke-free environment in all enclosed spaces, and this includes the vapors emitted by e-cigarettes.

Employers are advised to ensure that their workplace policies are updated to reflect these legal requirements and to educate employees about the restrictions on vaping.

By implementing designated smoking areas that adhere to the legal standards, businesses can avoid fines and contribute to a healthier working environment.

In response to these warnings, some companies are already taking proactive measures. Several organizations are revising their internal policies and installing clear signage to inform employees about the ban on vaping in all non-designated areas.

This move is seen as a crucial step in maintaining compliance and safeguarding public health. As the debate over vaping continues, it is clear that adherence to existing smoking laws is essential.

The legal framework is in place to protect individuals from the harmful effects of smoking and vaping, and understanding and complying with these regulations is crucial for both personal and professional environments.
