Dubai launches new court to hear inheritance cases

It is being hoped that this move will save time, provide flexibility to legal procedures and will also help to preserve family ties. The court also seeks to protect social and family bonds by assuring speedy settlement of inheritance cases.

The launch of the specialised inheritance court is arranged with Dubai’s ongoing efforts to improve the judicial system in Dubai Courts and simplify the litigation procedure.

The cases that will be exceeding values of Dh500,000 ($136,128) will be heard in this court.

Inheritance cases must be heard within the period of 30 days from the date of the file being lodged, and judgement must be given within a year.

Rulings issued by the court will be final and can only be appealed against it through a petition.

The strategy is also part of executing the directives of His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE and Ruler of Dubai, of making a world-class judicial system that will further strengthen the social and economic well-being of the people in the emirate.

Cases of any inheritance claim, if any, will be taken up by the same court. These include any civil, commercial, labour or property issues.

The tenure of litigation of any case can only be increased in particular circumstances and with consent from the head of the court.

A committee of judges from the courts of cessation, appeal and first instance will be made to manage cases at the new court.

Dubai Media office said, “This court lessens the time wasted in litigation procedures and referral of cases between specialised courts.”
